This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and the learned counsel for the State.

The Petitioner is an accused in connection with Special POCSO Case No.25 of 2022, pending on the file of the learned Addl. Sessions Jduge-cum-Special Court, POCSO, Angul, arising out of Thakurgarh P.S. Case No.84 of 2022 for commission of the alleged offence under Sections 363/342/376(1) IPC and Section 4 of the POCSO Act.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned A.D.J.-cum-Special Court under POCSO Act, Angul by order dated 28.06.2022, the present BLAPL has been filed.

Perused the statement of the victim recorded under Section 164 Cr.P.C.

Taking into account that the Petitioner is in custody since 23.03.2022 and filing of the charge sheet on 30.04.2022, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter. 7.

Accordingly, the BLAPL stands disposed of.
