This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

This I.A. has been filed seeking modification of the order dated 13.09.2022 passed in ABLAPL No.11077 of 2022. 3.

Heard learned counsels for the parties.

Learned counsel for the Petitioner submits that Petitioner No.2 - namely Bapi @ Ashutosa Khatei is having 2 more criminal antecedents in his name and Petitioner No.1 - namely Biju @ Bijay Kumar Pandi is having 1 more criminal antecedents in his name, which he could not informant this court at the time of passing of the order dated 13.09.2022, due to want of proper instruction from the clients.

Considering such submission of learned counsel for the Petitioners, Order No.01 dated 13.09.2022 passed in ABLAPL

// 2 // No.11077 of 2022 stands modified to the extent that the condition imposed with regard to verification of criminal antecedents of similar nature against the Petitioners, vide para-4 of the order, is hereby waived. However, further condition is imposed whereby the both the Petitioners shall furnish cash security of Rs.5,000/- (rupees five thousand) each to the satisfaction of the learned court in seisin over the matter, for their release on bail.

Four week's further time from today is extended for the Petitioners to surrender before the learned court below as per order dated 13.09.2022 passed in ABLAPL No.11077 of 2022, other conditions in the said order remaining unchanged. 7.
