This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsels for the parties.

This I.A. has been filed seeking modification of the condition in paragraph - 5, i.e., release of the Petitioner shall be subject to verification of Criminal Antecedents of the Petitioner and further if it is found that there is more than one criminal antecedents against the Petitioner, then the bail order shall stand automatically revoked. However, learned counsel for the Petitioner submits that on the selfsame occurrence, several F.I.Rs. have been lodged against the present Petitioner.

Considering such submission, the condition of verification of Criminal Antecedents of the Petitioner is hereby waived, but subject
// 2 // to the Petitioner furnishing cash security of Rs.3,000/- (Rupees Three Thousand) to the satisfaction of the learned court in seisin over the matter. The other conditions in the said order dated 14.09.2022 remain unchanged.

Four weeks' further time from today is extended for the Petitioner to surrender before the learned court below, vide the aforesaid order dated 14.09.2022, but subject to depositing cost of Rs.500/- (rupees five hundred) by the Petitioner in the Advocates' Welfare Fund of Orissa High Court Bar Association within 15 days from today and furnishing money receipt thereof in proof of the deposit.

It is made clear that, if the cost is not deposited within the time stipulated, the time extended for the petitioner to surrender shall stand revoked automatically.

The I.A. is disposed of accordingly.
