This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.584 of 2021 pending in the file of learned J.M.F.C., Sohela, arising out of Sohela P.S. Case No.207 of 2021, offence under Sections 379/511/34 of IPC read with Section 15(2) PMPL Act is in custody since 26.07.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Assistant Sessions Judge, Sohela by order dated 29.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

It is submitted by the learned counsel for the petitioner that because of his criminal proclivity, the petitioner has been arrayed as an accused in the case at hand.

Taking into account the nature of allegations and considering the period of custody, this Court directs the petitioner
to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Taking note of the fact that the petitioner is an outsider, this Court directs that one of the sureties shall be a member of the family and the petitioner shall appear before the jurisdictional police station once every week till the conclusion of investigation. 9.
Accordingly, the BLAPL stands disposed of.
