Heard Mr. S.N.Kar, learned counsel for the petitioner and Mr. Rajesh Tripathy, learned Additional Standing Counsel for the State.

The petitioner is seeking pre-arrest bail in connection with G.R. Case No. 1163 of 2020, pending in the file of learned S.D.J.M.(Sadar), Cuttack arising out of Purighat P.S. Case No.202 of 2020 for the alleged commission of offence punishable under Section(s) 498(A)/304(B)/302/34 of the IPC and read with Section-4 D.P.Act.

Taking into account the role ascribed to the petitioner and taking note of the order of this Court dtd. 17.02.2021 passed in ABLAPL No. 12372 of 2020, wherein the sister-in-law-Smt.
Binapani Mallick has been granted the benefit of Section-438 Cr.P.C and the statement at the Bar that the present petitioner is similarly circumstanced with the said Binapani Mallick, this Court is inclined to direct that, the petitioner shall be released, on surrendering within four weeks hence and moving for bail, the petitioner shall be released on bail on such terms as deemed just and proper by the Court in seisin of the matter. 5.
The order passed in ABLAPL No.12373 of 2020 is kept on record.

The ABLAPL is accordingly disposed of.
