Heard learned counsel for the parties and perused the case diary and all relevant papers produced from either side. 2.
This is an application under Section 439 Cr.P.C. filed by the Petitioners for bail in connection with Jarapada P.S. Case No.102 of 2021, corresponding to G.R. Case No.336 of 2021, pending in the court of learned J.M.F.C., Chendipada, which has subsequently been committed to the learned Additional District & Sessions Judge-cumSpecial Judge (Vigilance), Angul in Bail Application No.131/2021 (438/2021) for alleged commission of offences under Section 302 read with Section 34 I.P.C.

In course of hearing, learned counsel for the Petitioners submitted that he does not want to press this bail application in
// 2 // respect of Petitioner No.1, namely, Nitya @ Soubhagya Sahu. Accordingly, this bail application is confined to Petitioner No.2 only.

Upon perusal of the Case Diary, Post-Mortem Report and Statement of witnesses as well as the fact that Petitioner No.2 has been languishing in jail custody since the date of his arrest, i.e. from 23.06.2021, I am inclined to release the Petitioner no.2, namely, Puri @ Pursottam Sahu on bail in the above case on furnishing a bail bond of Rs.50,000/- (Rupees Fifty thousand) with one solvent surety for the like amount to the satisfaction of the learned court in seisin of the matter with condition that he shall not be involved in any criminal activities while on bail and shall report to the I.O. for the purpose of investigation once in a week. It is open to the court in seisin of the matter to impose any other condition(s) as would be deemed fit and proper in the facts & circumstances of the case. 5.
The BLAPL is accordingly disposed of.
