Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is a School established since 2007 and duly recognized by the Board of Secondary Education, Odisha. The Collector, Nayagarh sanctioned Mid-Day-Meal food stuffs as per the Govt. Guidelines during the year 2007. Subsequently, the Governor of Odisha visited the institution on 09.03.2010 and direction was issued to the Collector, Nayagarh to provide BPL rice, text books and other study materials, construction of school building including sanitation and drinking water facilities. A letter from the Joint Secretary to the Governor is enclosed as Annexure-8 to the writ petition.

It is submitted that though the Mid-Day-Meal food stuff were being provided to the institution but, without any apparent reason the same has been stopped from March, 2020 onwards. 5.
It appears that ventilating such grievance, the petitioner institution has approached the Collector, Nayagarh by submitting
a representation on 26.11.2021 followed by another representation dated 03.01.2022. It is stated that the said representations are pending.

Considering the limited grievance of the petitioner as also the fact that the appropriate authority appears to be in seisin over the matter, without expressing any opinion on merits of the case, the writ petition is disposed of with a direction to the Collector, Nayagarh to take a decision on the representations submitted by the petitioner referred above within a period of four weeks from the date of communication of this order or on production of certified copy thereof by the petitioner. The decision so taken shall be communicated to the petitioner.

The writ petition is disposed of accordingly. 8.
Issue urgent certified copy as per rules.
