This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

On the basis of oral prayer, learned counsel for the Petitioner is allowed to carry out necessary correction in the cause-title of the bail application in court today, so far as the case number is concerned.

Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

This bail application under Section 438, Cr.P.C. has been filed by the Petitioner apprehending arrest in connection with MHMM13-002350-2020 vide SS5900209/2020 pending in the Court of learned Addl. Chief Metropolitan Magistrate, Kurla 59, Maharashtra. On perusal of the summons issued to the Petitioner, it appears that the case was registered under Section 138 of the N.I. Act. On further perusal of the said summon it reveals that the same is bailable warrant of arrest. However, the contents of the summon

// 2 // reveals that Police has been authorized to arrest the Petitioner and produce him before the concerned court.

Considering the aforesaid facts, it is directed that the Petitioner shall not be arrested for a period of three weeks from today in connection with MHMM13-002350-2020 vide SS5900209/2020 pending in the Court of learned Addl. Chief Metropolitan Magistrate, Kurla 59, Maharashtra. However, the Petitioner is directed to appear before the concerned court within the aforesaid time of three weeks, failing which this order shall stand revoked automatically. 6.

With the aforesaid directions and observations, this ABLAPL is disposed of.
