This matter is taken up through Hybrid Mode.

The petitioner is an accused in connection with C.T. Case No. 4056 of 2019 corresponding to Mancheswar P.S. Case No. 379 of 2019, on the file of the learned District & Sessions Judge, Khurdha, Bhubaneswar for the alleged commission of offence under Sections-302/120 (B)/114/212/34 of the I.P.C.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned District & Sessions Judge, Khurdha, Bhubaneswar by order dtd. 15.09.2020 in T.R. No. 88 of 2020, the present BLAPL has been filed. 4.

Heard learned counsel for the petitioner and learned counsel for the State.

In view of the eye witness account of Chakradhar Behera and Manguli Jena, that the petitioner and other coaccused persons assaulted on different parts of the body of the deceased and that the petitioner started the assault and the Post Mortem Report findings which indicate that there are as many as fourteen injuries found on different parts of the body of the deceased and that a sword was recovered at the instance of the petitioner and the nature and gravity of the accusation, I am not inclined to release the petitioner on bail. 6.

Accordingly, the BLAPL stands rejected.

The petitioner is at liberty to renew the prayer for bail after examination of the eye witness in the Trial Court. 8.

Urgent certified copy of this order be granted as per rules.
