This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the Petitioner for anticipatory bail, involving offence punishable under Sections 395, I.P.C.

It is submitted by learned counsel for the Petitioner that three of the co-accused persons have already been released on bail by the court below. Learned counsel for the State submits that in the meantime investigation has been concluded and charge-sheet has been filed in the case, wherein the name of the present Petitioner does not find place.

Considering such submission, this Court is of the view that there is no apprehension of arrest of the Petitioner. However, it is

// 2 // open for the Petitioner to surrender and move for bail before the learned S.D.J.M., Rayagada in G.R. Case No.382 of 2021 corresponding to Seskhal P.S. Case No.63 of 2021 within a period of three weeks from today, and in that event he shall be released on bail on such terms and conditions as the learned Magistrate may deem just and proper in the facts and circumstances of the case. 6.

The ABLAPL is disposed of accordingly.
