This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in S.T. Case No.81 of 2022 pending in the file of learned 1st Addl. District & Sessions Judge, Rourkela, arising out of Tangarapli P.S. Case No.79 of 2022, for offence under Sections 341/294/506/376(2)(n)/354-A(2) IPC. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Addl. C.J.M-cum-A.S.J., Rourkela by order dated 29.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the statement of the victim recorded under Section 164 Cr.P.C.

It is submitted by the learned counsel for the Petitioner that the charge sheet in the aforesaid has been filed on 13.04.2022 and further continuance of the Petitioner in custody is unwarranted. 7.

Considering the manner of accusation and the period of custody, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter. 8.

Accordingly, the BLAPL stands disposed of.
