This matter is taken up through hybrid mode.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are accused in G.R. Case No.163-A of 2022 arising out of Barbil P.S. Case No.54 of 2022, pending in the Court of learned J.M.F.C., Barbil, for offences under Sections 406/407/420/120-B/34 of IPC.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Champua, by order dated 03.09.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioners submit that apt of the total amount of about Rs.11,43,998/-(Rupees eleven lakh forty three thousand nine hundred ninety eight), about Rs.8,11,111/-(Rupees eight lakh eleven thousand one hundred eleven) has been secured by freezing the account of one Gautam Trucking Private Ltd.
Hence, it is submitted that as substantial amount involved has already been secured, keeping in view the role ascribed to them and more so when charge-sheet has been filed, further continuance of the petitioners in custody is unwarranted.

Learned counsel for the State opposes the prayer for bail. 7.
Considering that substantial amount has been recovered as noted above and taking note of the observation of the learned Court below that one Surendra Yadav is the king-pin, as revealed from the investigation, this Court directs the petitioners to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
