1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.
2. Heard Mr. P.R. Barik, learned counsel for the Petitioner.
3. The present writ Petition has been filed challenging the order dtd.05.10.2020 passed by the O.P. No. 2 under Annexure-6. It is submitted that though the Petitioner has deposited the entire amount as directed, but without considering the same the impugned order was passed. Since the impugned order is an appealable one, this Court is not inclined to entertain the prayer as made in the writ Petition.
4. However, considering the submission made by Mr. Barik, this Court permits the Petitioner to file necessary appeal before the Competent Court within a period of three (3) weeks from today. It is observed that, if any such appeal will be filed within the aforesaid time period along with the interim application, the said competent Court shall take up the interim application and pass appropriate
// 2 // order thereon within a further period of two (2) weeks. Till the interim application is considered and appropriate order is passed, the operation of the impugned order dtd.05.10.2020 be kept in abeyance.
5. The writ Petition is disposed of.
