This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioners and the learned Additional Standing Counsel. Perused the records. 3.

This is an application under Section 438 Cr.P.C. filed by the Petitioners for anticipatory bail.

It is submitted by the learned counsel for the Petitioners that the Petitioners are no way connected with the alleged offence and they have been falsely implicated in this case due to the previous ill feeling with the informant. It is also submitted by the learned counsel for the Petitioners that the allegations made against the Petitioners are omnibus in nature. The co-accused namely Aitu Harijan has been released on bail by this Court in ABLAPL No.9104 of 2022 by order dated 03.08.2022.

Considering the nature of allegations made, gravity of the

// 2 // offence and the fact of the case, I am not inclined to grant anticipatory bail to the Petitioner. However, it is directed that in the event the Petitioner surrenders before the learned S.D.J.M., Nabarangapur in G.R.Case No.676 of 2022 arising out of Papadahandi P.S.Case No.89 of 2022 within a period of three weeks from today and moves for bail, he shall be released on bail on such terms and conditions as would be deemed just and proper by the learned Magistrate.

The ABLAPL is accordingly disposed of.
