This is an application under Section 439 Cr.P.C. filed by the Petitioner for bail in connection with Angul P.S. Case No.407 of 2021, corresponding to Special POSCO Case No.55 of 2021, pending in the court of learned Additional District Judge-cumSpecial Court under POCSO Act, Angul, for commission of alleged offences under Sections 363/376(3)(2)(n) of I.P.C. read with Section 6 of POCSO Act, 2012.

Heard learned counsel for the parties and perused the case diary, F.I.R., statements of the victim girl recorded under Sections 161 and 164 Cr.P.C.

Upon consideration of the submissions made by the respective parties as well as on perusal of the records and on consideration of the peculiar facts and circumstances of the case and

// 2 // the fact that Petitioner is in jail custody since the date of his arrest, i.e. from 13.8.2021, I am inclined to release the Petitioner, namely, Prajaranjan Roul @ Raja on bail in the above case on furnishing a bail bond of Rs.30,000/- (Rupees Thirty thousand) with one solvent surety for the like amount to the satisfaction of the learned court in seisin of the matter subject to conditions that the Petitioner shall cooperate with the I.O. in the investigation and shall not tamper with the evidence and threaten the witness in any manner whatsoever. Further, it is open to the court in seisin of the matter to impose any additional condition(s), if situation so warrants. 4.

The BLAPL is accordingly disposed of.
