Mr. S.K. Sarangi, learned Senior Advocate for the petitioner submits that the petitioner should be granted liberty to file a better application for the reason stated.

In such view of the matter, the CRLMC stands disposed of with a liberty as prayed for.

It is made clear that the order dated 28th July, 2022 passed in ICC No.706 of 2021 shall not stand as a bar for the petitioner to move afresh before the learned S.D.J.M.(S), Cuttack. (R.K. Pattanaik) Judge U.K.Sahoo
