Mr. Bhuyan, learned advocate appears on behalf of petitioner and files affidavit pursuant to direction made by coordinate Bench in order dated 11th October, 2022.

Mr. Sharma, learned advocate, Additional Government Advocate appears on behalf of State and submits, appeal has been preferred against impugned order made by the Tahasildar. The affidavit filed says so. In the circumstances, the writ petition is not maintainable.

We have obtained confirmation from Mr. Bhuyan that application for certified copy of impugned order dated 19th August, 2022 was put in on 30th August, 2022. His client has said on oath that due to want of certified copy, the appeal was filed with extract of impugned order and not numbered till date. Opposite party no.3 is directed to issue certified copy of impugned order, forthwith. 4.

Sub-Collector, Puri is a functionary of State. Said office is directed to register and number the appeal filed by petitioner, upon issuance and production of the certified copy. On the appeal having been registered, the Sub-Collector will proceed to expeditiously deal with and dispose of the same.

There will be stay of operation of impugned order till 30th November, 2022. The order will stand automatically extended in event, in spite of approach, certified copy is not issued or the Sub-

// 3 // Collector omits to register and number the appeal. If the appeal is registered and numbered in the meantime, extension of the interim measure must be obtained by petitioner from the Sub-Collector. 6.

The writ petition is disposed of as above.
