This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in Cantonment P.S. Case No.118 of 2022 corresponding to G.R. Case No.1056 of 2022, pending in the Court of learned S.D.J.M.(S), Cuttack, for offences under Section 379 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 2nd Additional Sessions Judge, Cuttack, by order dated 05.09.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Taking into account the nature of allegations and the punishment prescribed, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Since it is stated at the Bar that the petitioner is a first offender, learned Court in seisin over the matter to fix the terms. 8.

Accordingly, the BLAPL stands disposed of.
