This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with G.R. Case No.99 of 2022, pending in the file of the learned J.M.F.C., Kabisuryanagar, arising out of Kabisuryanagar P.S. Case No.99 of 2022, for alleged commission of offences under Section 409/34 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District & Sessions Judge, Kodala, Ganjam, by order dated 16.08.2022 in the aforementioned case, the present BLAPL has been filed. 5.

It is submitted by the learned counsel for the petitioner that the manager of bank in question to whose account the embezzled amount was ultimately transferred via the account of the present

petitioner has since been released on bail by this Court by order dated 16.09.2022 in BLAPL No.3726 of 2022.

Learned counsel for the State on instruction does not dispute such statement that the entire amount was remitted back to the account of bank manager, who has since been released. 7.

Considering the release of the co-accused and that chargesheet has already been filed on 13.07.2022 and the petitioner is in custody since 15.03.2022, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
