1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.

2. Heard Mr. D.K. Mohapatra, learned counsel for the Petitioner.

3. This transfer petition has been filed seeking transfer of S.T. No. 326 of 2019 from the Adhoc Addl. District & Sessions Judge (F.T.S.C.), Kendrapara to the Court of learned District & Sessions Judge, Bhadrak.

4. It is contended that the Petitioner who is the informant in the aforesaid case is regularly being harassed by the accused person and she has got genuine apprehension towards her life while giving deposition during the trial. In view of such threat perception, the Petitioner is not feeling safe to take her witnesses to depose on her behalf.

5. Taking into account the nature of allegation, this transfer petition is disposed of by giving liberty to the Petitioner to move the learned District Judge, Kendrapara under the Witness Protection Scheme, 2019 in order to provide her as well as her witnesses protection for

// 2 // their appearance in the aforesaid case to give evidence. If any such application is moved before the learned District Judge, Kendrapara, appropriate action will be taken on the same as provided under the said scheme.
