Heard learned counsel for the petitioner and learned Standing Counsel for the State.

The limited prayer is made by learned counsel for the petitioner that the petitioner was directed to surrender before learned court below and be released on bail along with others by this Court's order dated 3rd November, 2021 in ABLAPL No.4388 of 2021 but then, he could not avail it and in such view of the matter, a direction may be made once again for him to surrender and released on bail with any conditions. It is further directed that though extension was sought for in I.A. No.785 of 2022, it could not be listed before this Court and in order to avoid delay, the above direction should be made in the interest of justice. 3.

A copy of the order dated 3rd November, 2021 in ABLAPL No.4388 of 2021 is produced today in Court by the learned counsel for the petitioner and the same is perused. It is revealed that the petitioner and other accused persons were directed to surrender

within a period of six weeks and as submitted by the learned counsel for the petitioner, the said opportunity could not be availed of.

Having regard to the above facts and considering the submission of the learned counsel for the petitioner, the CRLMC stands disposed of with a direction to the petitioner to surrender before the learned J.M.F.C., Ersama in connection with G.R. Case No.349 of 2021 on or before 14th October, 2022 and in the event of his surrender, the court below shall release him on bail with conditions as deemed just and proper.

An urgent certified copy of this order be granted as per rules.
