1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.

2. Heard learned counsel for the Petitioner and learned counsel for the Opposite Parties.

3. The Petitioner has filed the present Writ Petition with the following prayer:- "Therefore it is most humbly prayed that this Hon'ble Court may be graciously pleased to admit this writ petition, call for the records, issue rule Nisi calling upon the Opp. Parties to show cause as to why the petitioner shall not be provided the post under group-C as per the prevailing Rule i.e OCS(RA)rule 1990. Failing to show cause showing insufficient cause issue the appropriate writ and order directing the opp. parties to provide the compassionate appointment of Group-C post to the petitioner considering her application dtd.23-01-2020 in the light of the judgment passed by the Hon'ble apex court dtd 20-05-2022 in the case of Malayananda Sethy vs State of Odisha and others in civil appeal No. 4103 of 2022 arising out of SLP (Civil) No. 936/2022.

// 2 // And/or pass any such other order/orders, direction/directions as this Hon'ble court may deem fit and proper for the ends of justice;

And for this act of kindness, the petitioner shall as in duty bound ever pray."

4. However, taking into account the claim raised in the present Writ Petition, liberty is granted to the Petitioner to make a fresh representation before Opp. Party No.2 by enclosing all the relevant documents and citations in support of her claim, if any, within a period of three weeks hence.

5. It is observed that if such a representation is filed within the aforesaid period, Opp. Party No.2 shall do well to take a lawful decision on the same within a period of three months from the date of receipt of such representation. The order so passed by the Opp. Party No.2 be communicated to the petitioner.

6. With the aforesaid observation and direction, the Writ Petition is disposed of.
