Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 24.08.2021 in connection with Khallikote P.S. Case No. 515 of 2021 corresponding to S.T. Case No. 04 of 2022 pending in the court of learned Additional Sessions Judge, Khallikote for the alleged commission of offence under Sections 498-A/302/304(B)/34 of IPC read with Section 4 of D.P. Act.

His earlier application for bail was rejected by this court granting him liberty to renew his prayer after examination of some material witnesses in the case. The said order was passed on 04.03.2022. More than eight months have elapsed in the meantime. It is submitted that the case has been committed to the court of Sessions but charge has not yet been framed.

Having regard to the fact that the earlier application was rejected on merits, while not being inclined to grant regular bail, keeping in view the fact that the petitioner is in custody for more than one year and three months, the bail application is disposed of directing the learned court below to release the petitioner on interim bail for a period of three months from the date of his actual release on such terms and conditions as it may deem fit and proper to impose. He shall surrender to custody on expiry of the aforesaid period failing which appropriate warrant may be issued for his production.

The BLAPL is accordingly disposed of.
