ORDER

13.09.2022 1.This matter is taken up through hybrid mode.

2. Heard.

3. In this writ petition, the petitioner has sought for direction of this Court to quash the deployment order dated 26.08.2022 under Annexure-2 issued by the opposite party No.2 which has been issued in violation of G.A.Department Resolution dated 29.07.1991 under Annexure-3 and allow him to continue in his present place of posting.

4. The brief facts of the case is that the petitioner was appointed as Junior Clerk of Bhingarpur Girls' School on 02.08.1984 by the Secretary of the Managing Committee of the said School. While continuing as such in the said school, he was deployed in the office of the B.E.O.,Balipatna vide order dated 16.01.2014 issued by opposite party No.3. But

// 2 // subsequently, cancelled and posted at Bhagabati Nodal High School Sarankana. Hence, this writ petition.

Learned counsel for the petitioner submits that though the petitioner has submitted representation dated 05.09.2022 before the opposite party No.3/District Education Officer, Khurdha on 26.04.2022 under Annexure-4 for cancellation of the order of redeployment dated 26.08.2022 as he has left one year and eight months for retirement. Moreover, he has been undergoing treatment at Hi-tech Medical College for his accident but the same has not yet been taken into consideration by the opposite parties.

Considering the limited grievance of the petitioner, without expressing any opinion on the merits of the case, this Court disposes of the writ petition directing the opposite party No.3 to take a decision on the representation filed by the petitioner vide Annexure-4 taking into account of his considerable time in service in said school, within a period of one month from the date of production of authenticated/ certified copy of this order by the petitioner. 7.With the aforesaid observation, the writ petition is accordingly disposed of.
