This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in 2(a) CC Case No.133 of 2022 pending in the file of learned J.M.F.C. Gondia, arising out of Gondia Excise P.R. Case No.56 of 2022, offence under Sections 52(a)(i) of Odisha Excise Act and is in custody since 04.08.2022. 4.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Dhenkanal by order dated 07.09.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the nature of accusation and the punishment prescribed and the period of custody, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Taking into account the criminal proclivity of the petitioner this Court directs him to appear before the concerned Excise Officer till the submission of final P.R. 7.

Accordingly, the BLAPL stands disposed of.
