This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.71 of 2022 (POCSO) pending in the file of learned Additional Sessions Judgecum-Special Judge (POCSO) Kendrapara, arising out of Rajkanika P.S. Case No.277 of 2022, offence under Sections 292(3)(2)(a)/500 of IPC read with Section 12 and 14 of the POCSO Act and Section 66E and 67B of the I.T. Act along with Section 8 of POCSO Act. 4.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned ADJ-cum-Spl. Judge (POCS) Kendrapara by order dated 07.09.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the164 Cr.P.C statement of the victim.

It is submitted by the learned counsel for the petitioner that he is in custody since 07.08.2022 and since there is substantial progress in investigation, he may be released on bail. 7.

Learned counsel for the State opposes the prayer for by inter alia on the ground that case against the petitioner has been clearly made out under Section 66E and 67B of the I.T. Act. 8.

Taking into account the submissions and considering the period of custody, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
