Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is the accused in connection with G.R. (G.N) Case No.45 of 2022, pending on the file of learned Nyayadhikari Gram Nayalaya, Kolnara, arising out of Chandili P.S. Case No.93 of 2022 for the alleged commission of offence under Sections 306/34 IPC.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Addl. Sessions Judge, Rayagada by order dated 02.09.2022, the present BLAPL has been filed. 4.

The Petitioner had moved this Court earlier in BLAPL No.7029 of 2022 and this Court by order dated 12.08.2022 while granting bail to the co-accused taking into account the suicidal note of the deceased was not inclined to entertain the bail application of

the present Petitioner who was the Petitioner No.4 in the said bail application.

Since such application was considered post charge sheet and there being no change in circumstance, this Court is not inclined to entertain this bail application at this stage. 6.

Accordingly, BLAPL stands rejected.
