Heard learned counsel for the Parties.

On oral submission learned counsel for the Petitioner is permitted to make necessary correction in the cause title at Petitioner side in Court.

The Writ Petition involves the following prayer:- "It is therefore, humbly prayed that this Hon'ble Court may be graciously pleased to admit the Writ petition, issue notice to the Opp. Parties and after hearing both the sides this Hon'ble Court may be directed to the Opp. Party no.3 not to construct any High School building of Aghirapada in the premises of Arjun Chran Nodal Primary School, Aghirapada as this Hon'ble Court may be deemed fit and proper to this law;

And further be pleased a direction may be given to the Opp. Party no.2 to dispose of the representation made by the petitioner within a stipulated period in view of Annexure-3;

And may further be pleased to pass any other order (s) for the better interest of Justice, equity and good conscience;

And for which act of kindness, the petitioner as in duty bound shall ever pray."

Considering the innocuous prayer involved herein, this Court directs the Collector, Balasore- Opposite Party No.2 to consider the grievance of the Petitioner at Annexure-3 and take appropriate decision also involving the Party likely to be affected with opportunity of hearing to all concerned by completing the entire exercise at least within a period of three months.

In the event the alleged construction has not been undertaken, there should be status quo on the construction for this period. (Biswanath Rath) Judge Swarna
