This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in Kutra P.S. Case No.34 of 2022 corresponding to G.R. Case No.146 of 2022, pending in the Court of learned J.M.F.C., Rajgangpur, for offences under Section 376(1) of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Sundargarh, Camp at Rajgangpur, by order dated 20.07.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement of the victim and the rejection order.

It is submitted by the learned counsel for the petitioner that in the meanwhile charge-sheet has been filed on 23.04.2022, hence his further continuance in custody is unwarranted.

Taking into account that the petitioner is in custody since 28.02.2022 and filing of the charge-sheet, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
