This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in Special Case No.109 of 2022, pending in the Court of learned A.D.J. cum Special Court under POCSO Act, Cuttack, arising out of Neemalo P.S. Case No.138 of 2022, for offences under Sections 294/354(D)/379/506/34 of IPC read with Section 12 of the POCSO Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned A.D.J. cum Special Court under POCSO Act, Cuttack, by order dated 05.09.2022 in the aforementioned case, the present BLAPL has been filed. 5.
Perused the 164 Cr.P.C. statement of the victim. 6.
Taking into account that there has been substantial progress in the investigation and the petitioner is in custody from 04.08.2022, this Court directs the petitioner to be released on bail
on such terms to be fixed by the learned Court in seisin over the matter.

Additionally it is directed that the petitioner shall appear before the jurisdictional police station once every week till the conclusion of investigation.

Accordingly, the BLAPL stands disposed of.
