This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.810 of 2022, arising out of Chhendipada P.S. Case No.421 of 2022, pending before the Court of learned J.M.F.C., Chhendipada, for commission of offences under Sections 419/420/384/506/34 of IPC. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District & Sessions Judge -cum- Special Judge (Vigilance), Angul, by order dated 07.09.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that one record keeper, co-accused was directed to be released on anticipatory bail by this Court by order dated 19.09.2022 in

ABLAPL No.11545 of 2022. Learned counsel for the petitioner submits that taking into account the role ascribed to the petitioner and the amount involved, the petitioner may be permitted to release on bail also inter alia on the ground of parity. 6.

Learned counsel for the State opposes the prayer stating that the petitioner is the prime accused.

Taking into account the release of the co-accused on anticipatory bail and as investigation has progressed substantially as submitted by the learned counsel for the petitioner, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
