This matter is taken up through hybrid mode.

The Petitioner in this writ petition seeks to assail the order of attachment under Annexure-1 issued by the Tax Recovery Officer-cum-R.T.O., Keonjhar-Opposite Party No.3 in respect of the vehicles bearing Registration Nos.0R-04-F-0039 and OR-14Q-4945. 3.

In course of hearing, Mr. Jena, learned counsel for the Petitioner submits that pursuant to the order dated 13th July, 2022 passed in W.P.(C) No.1317 of 2022, the Petitioner has already moved the State Transport Authority assailing the demand notice issued in respect of the aforesaid vehicles. He further submits that the order impugned herein is appealable under Section 78 of Schedule-II of the Odisha Motor Vehicle Taxation Act, 1975 and prays for withdrawal of the writ petition.

In view of such submission, this writ petition is disposed of as withdrawn.

Urgent certified copy of this order be granted on proper application.
