This application under Section 482 Cr.P.C. has been filed by the petitioner challenging the order dated 13.07.2022 passed by the learned J.M.F.C., Bhuban in G.R. Case No. 102 of 2014 arising out of Bhuban P.S. Case No. 102 of 2014 for the alleged offence under Section 7 of the E.C. Act.

From perusal of paragraph 4 and 5 of the application, it appears that the petitioner had filed an application under Section 239 of the Cr.P.C. for discharging him from the alleged offence under Section 7 of the E.C. Act and the same has been rejected by order dated 05.05.2022 and thereafter charge has been framed against him vide the impugned order dated 13.07.2022. But the order dated 05.05.2022 has neither been challenged nor has been annexed to this application. 3.

Mr. Saroj Kumar Dash, learned counsel for the petitioner prays for liberty to withdraw this application in order to file an application challenging the order dated 05.05.2022 rejecting his application for discharge and the order dated 13.07.2022 framing charge.

Considering the said submission, the 482 application is disposed of as withdrawn granting the liberty as prayed for. 5.

Urgent certified copy of this order be granted on proper application.

The certified copy of impugned order dated 13.07.2022 (Annexure-4) passed by the learned J.M.F.C., Bhuban be returned to the learned counsel for the petitioner on being substituted by an attested photostat copy.
