Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with C.T. Case No.26 of 2022, pending in the Court of the learned 3rd Additional Sessions Judge, Bhubaneswar arising out of Lingaraj P.S. Case No.189 of 2020, for commission of alleged offences under Sections 302/294/506/120-B/34 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 3rd Additional Sessions Judge, BBSR by order dated 02.09.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the State fairly submits that the petitioner is similarly circumstanced with co-accused Dillip Ku. Behera@ Dilu who has since been released on bail by order dated 10.08.2022 in BLAPL No.6307 of 2022 and Balaram Behera @ Bauria by order dated 02.09.2021 in BLAPL No.3902 of 2021,

Sasmita Behera order dated 31.08.2021 in BLAPL No.1911 of 2021.

Taking into account the release of the co-accused who are similarly circumstanced as stated at the bar, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin so as to ensure his presence on each date of trial.

Accordingly, the BLAPL stands disposed of.
