This matter is taken up through hybrid mode.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are accused in Angul Sadar P.S. Case No.598 of 2022, corresponding to G.R. Case No.1160 of 2022, pending in the Court of learned S.D.J.M., Angul, for commission of offences under Sections 407/120-B/34 of IPC.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Additional District & Sessions Judge-cum-Special Judge (Vigilance), Angul, by order dated 05.09.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioners that primarily the allegation is one under Section 411 of IPC and the petitioners are not named accused.

Taking into account such submission and on consideration of the forwarding report, this Court directs the petitioners to be released on bail on such terms to be fixed by the Court in seisin over the matter.

As it is submitted that the petitioners do not have any criminal proclivity, while releasing the petitioners on bail, the learned Court below shall verify such assertion. If it comes to the fore that the petitioners have any criminal antecedent, this order shall stand recalled without any further reference to this Court. 8.

Accordingly, the BLAPL stands disposed of.
