Heard learned counsel for the petitioner and learned counsel for the State.

Instant petition under Section 482 Cr.P.C. is filed by the petitioner challenging the order of NBW dated 27th August, 2019 passed in G.R. Case No.1545 of 2018 pending in the court of learned S.D.J.M., Dhenkanal on the grounds stated therein. 3.

The limited prayer is that the other co-accused persons are already on bail but then the NBWAs issued by the learned court below, which is pending for execution. In such view of the matter, direction may be issued to surrender the petitioner before the learned court below and consider the same in accordance with law but taking into account the claim of parity, if any. 4 .

In view of such submission, the CRLMC stands disposed of directing the petitioner to surrender before the learned S.D.J.M., Dhenkanal on or before 30th September, 2022 in connection with

G.R. Case No.1545 of 2018 and in the event of his surrender, the court below shall release him on bail in the first hour and disposed of the same on the same day. For the said purpose, case diary be made available at the cost of the petitioner. In case any parity is claimed, it shall be examined and appropriate direction may be issued in that regard.
