This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

This is an application under Section 439 Cr.P.C. filed by the Petitioner for bail in connection with Raruan P.S. Case No.110 of 2021, corresponding to C.T. Case No.653 of 2021 pending in the file of learned S.D.J.M., Karanjia, for commission of alleged offences under Sections 457/395/307 of IPC.

Heard learned counsel for the Petitioner and learned counsel for the State. Perused the case records.

During course of hearing, learned counsel for the Petitioner seeks leave to withdraw the bail application with liberty to renew his prayer at a later stage. He further prays for a direction to the learned trial court to expedite the trial of the case. 5.

In such view of the matter, the bail application is disposed of as withdrawn. However, this Court directs that the trial court to

// 2 // make an endeavor to expedite the trial of the aforesaid case and conclude the same preferably within a period of four months from the date of this order. In the event trial of the case has not been completed within the aforesaid time, it is open to the Petitioner to file fresh bail application. In such event, the trial court shall consider the prayer of the Petitioner in accordance with law without being influenced by any other factor.

The BLAPL is disposed of with liberty as prayed for. 7.
