This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.60 of 2022 pending in the file of learned District and Sessions Judge-cum-Judge, Special Court Bargarh, arising out of Bhatli Excise Station P.R. No.122 of 2022-23, offence under Sections 21(b) of the NDPS Act and in custody since 20.08.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Bargarh by order dated 26.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Taking into account the seizure of 410 bottles of Eskuf Syrup which comes to 82 gms of Codeine Phosphate which
evidently is less than commercial quantity, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter, keeping in view the assertion that the petitioner has no criminal proclivity 7.
Accordingly, the BLAPL stands disposed of.
