1. This matter is taken up through hybrid mode. Order No.

2. Heard learned counsel for the Appellant No.1 and learned Addl. Standing Counsel for the State.

3. The Appellant No.1 is in custody since 31st August, 2022 in connection with Dhauli P.S. Case No.173/2022 corresponding to C.T. No.253/2022 pending in the court of learned Sessions Judge, Khurda at Bhubaneswar.

4. As directed a comprehensive affidavit has been filed on behalf of the Appellant No.1 stating the details of the three cases instituted against him. It is seen that in one case, he has been released on bail and in other two cases he has complied with the notice under Section 41-A of Cr.P.C.

5. Taking into consideration the nature of accusations and the fact that the co-accused who stands on the same footing has been released on bail, I am inclined to allow the prayer for bail. Let the Appellant No.1 be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the trial court on each date of posting of the case without fail.

6. The CRLA is disposed of.

7. Urgent certified copy of this order be granted on proper application.
