This matter is taken up through Hybrid Mode.

Order No 2.

At the outset, Mr. N.C. Das, learned counsel for the petitioner confines his prayer with regard to the pendency of Surcharge Proceeding No. 37/10.

Considering the innocuous nature of prayer made in the Writ Petition, the writ petition is disposed of with a direction on opp. party No.2 to dispose of Surcharge Proceeding No. 37/10 within a period of three months from the date of receipt of this order, if there is no legal impediment.

This Court also directs opp. party No.1 to take step for release of 6th Pay arrear, as sanctioned in favour of the petitioner vide Annexure-2 dated 15.4.2010 within a period of one month from the date of receipt of this order, if it is legally payable to the petitioner in view of the subsequent developments which has taken place in the meantime.
