This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

This is an application under Section 439 Cr.P.C. filed by the Petitioner for bail in connection with Jeypore Town P.S. Case No.349 of 2020 corresponding to T.R. Case No.92 of 2020, pending in the Court of the learned Special Judge, Jeypore for commission of the alleged offences under sections 20(b)(ii)(C) of the N.D.P.S. Act. 3.

Heard learned counsel for the parties and perused the case diary, F.I.R., statements of the witnesses recorded by the Police during investigation 4.

Upon consideration of the submissions made by the respective parties as well as on perusal of the records and on consideration of the peculiar facts and circumstances of the case, co-accused has already been released on bail and keeping in view the length of detention of the petitioner in custody, I am inclined to release the Petitioner on bail in the aforesaid case on furnishing bail bond of Rs.50,000/- (fifty thousand) with two solvent sureties, each for the

// 2 // like amount to the satisfaction of the learned court in seisin over the matter subject to the conditions that the Petitioner shall not be involved in any offence of similar nature, he shall not tamper with the prosecution evidence or try to threaten or influence the witnesses in any manner whatsoever, shall not make any default in attending the court during trial on each date of posting and shall appear before the concerned Police Station once in a fortnight preferably on 'Sunday' in between 10.00 A.M. to 1.00 P.M. till conclusion of trial. Violation of any of the terms and conditions shall entail cancellation of bail. 5.

It is open for the court in seisin over the matter to impose other conditions may deem just and proper.

It is further directed that the bail granted to the Petitioner is subject to the condition that learned court below shall verify whether the Petitioner has any criminal antecedents. In the event it is found that the Petitioner has any criminal antecedents, this bail order shall automatically stand revoked.

The BLAPL is accordingly disposed of.
