Heard learned counsel for the Parties.

The Writ Petition involves the following prayer :- "In view of the aforementioned facts and circumstances of this case, it is respectfully prayed that your lordships would graciously be pleased to issue Rule NISI; calling upon the opp. parties to show cause as to why the claim proposal of the petitioner under Anneuxre-2 for sanction of Capital Investment Subsidy shall not be considered under the provisions of Odisha Food Processing Policy-2013 applying the settled principles in the matter of M/s.Maas Bhairabi Industries LLP Versus State of Odisha and others under Annexure-8, if the opp.parties fail to show cause or show insufficient cause then the Rule be made absolute eventually directing the opp.parties to consider forthwith for sanction of Capital Investment Subsidy in favour of the Petitioner as per the principles settled in the aforesaid judgment for the interest of justice."

It appears, the Petitioner has already submitted CIS proposal, vide Annexure-2. The Petitioner while seeking a direction for disposal of the same also seeks the benefit through the judgment of

In the process, this Court in disposal of the Writ Petition directs O.P.2 to look into the request of the Petitioner involving Annexure-2 and take a lawful decision at least within a period of one and half months but however keeping in view the principle already decided through the decision indicated herein above. The Petitioner is permitted to serve a copy of this order and copy of the Writ Petition along with copy of the aforesaid judgment so relied before the Competent Authority within two working weeks from the from the date of submission.
