This matter is taken up through hybrid mode.

Order dated 17th August, 2022 (Annexure-2) passed by learned Additional Civil Judge (Senior Division), Kendrapara in C.S. No.117 of 2010 is under challenge in this CMP, whereby an application to call for the records in T.S. No.310 of 1998 and C.S. No.83 of 2009 from the record room of the Court of learned District Judge, Cuttack has been rejected.

In course of hearing, Mr. Acharya, learned counsel for the Petitioner submits that since the documents are available in the record room of the Court of learned District Judge, Cuttack, he can avail the certified copies of the same and produce it before learned Additional Civil Judge ( Senior Division), Kendrapara in C.S. No.117 of 2010 for consideration. 4.

In view of the submission made by learned counsel for the Petitioner, the CMP is disposed of with an observation that the Petitioner, if so advised, may obtain the certified copies of the aforesaid case records and produce it before learned Additional Civil Judge (Senior Division), Kendrapara in C.S.

// 2 // No.117 of 2010 and in that event, the same may be considered in accordance with law.

Urgent certified copy of this order be granted on proper application.
