Heard learned counsel for the petitioner and learned Standing Counsel for the Vigilance Department. 2.

Instant petition under Section 482 Cr.P.C. is filed by the petitioner praying for quashing of the order of NBWA dated 28th June, 2010 passed by the learned S.D.J.M., Khurda in G.R. Case No.353 of 2007 arising out of Tangi P.S. Case No.65 of 2007 on the grounds stated therein.

Perused the copy of the FIR as at Annexure-1 and copy of the impugned order under Annexure-2.

As submitted by the learned counsel for the petitioner that an application under Section 317 Cr.P.C. was filed and also a time petition on the date fixed but the court below rejected the same and thereafter, issued the NBWA. It is submitted that after the case was committed to the Sessions court, NBWA was issued against the petitioner.

While disposing of the CRLMC, the petitioner is directed to surrender before the learned S.D.J.M., Khurda on or before 20th October, 2022 in G.R. Case No.353 of 2007 arising out of Tangi P.S. Case No.65 of 2007 and in the event of his surrender, the court below shall release him on bail subject to conditsions. 6.
