Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is stated to be in custody dtd.02.09.2020. The charge sheet in the case has been filed on 29.10.2020 under Sections-417/376 (20(n)/506, I.P.C.

It is alleged that the accused had committed the offence of rape on false assurance of marriage.

Taking into account, the period of detention and taking note of the fact that the trial has not commenced as stated by the learned counsel for the petitioner, this Court is inclined to direct release of the petitioner in exercise of power under Section 439

Cr.P.C. The learned Court below in seisin of the matter to be fixed the terms.

The BLAPL stands disposed of accordingly.
