ORDER (Oral) 26.10.2022 01.

1. This matter is taken up through virtual mode.

2. Present contempt has been filed for the alleged noncompliance of the order dated 1.8.2019 passed by this Court in W.P.(C) No. 31018 of 2011 whereby the official authorities were directed to extend the benefit under the scheme of Rehabilitation & Resettlement in respect of employment on account of the land of the petitioner having been acquired.

3. Upon notice, an affidavit dated 15.9.2022 of Shri Ajay Kumar Dehury, General Manager, MCL, Lingaraj Area has been filed. Paras 3 & 4 of the same read as under :

"3. That the Company pursuant to the direction of this Hon'ble Court has been pleased to provide appointment under the "under the land loser scheme" to the nominee Sri Manas Ranjan Naik, S/o Abhiram Naik, At village-Hensmul vide appointment letter dt. CL/GM/LA/P&A/LO/Appointment/21/805 dt.11.05.2021 which was approved vide letter dt. MCL/GM (P&IR)-NEE/LO(LA)-A/2022/1414 dt.12.09.2022.

True copy of the letter of the Office Order dt.12.09.2022 is annexed herewith as AnnexureA/2.

4. That, it is humbly submitted that the appointee Sri Manas Ranjan Naik has accepted the said employment and his place of posting has approved to be at IWSS, Lingaraj Area. The said has been communicated by the General Manager (I-PR & MP/NEE) to the General Manager, Lingaraj Area, MCL vide letter No. MCL/GM (P & IR) )-NEE/LO(LA)- A/2022/1414 dt.12.09.2022.

True copy of the letter of the letter dt.12.09.2022 is annexed herewith as Annexure-B/2."

4. Counsel for the petitioner, in view of the aforesaid, concedes that the present contempt has become infructuous.
