Heard learned counsel for the petitioners and learned counsel for the State.

Instant petition under Section 482 Cr.P.C. is filed by the petitioners challenging the criminal proceeding in C.T. Case No.755 of 2019 arising out of Jakhapura P.S. Case No.41 of 2019 pending in the court of learned J.M.F.C., Jajpur Road on the grounds stated therein.

The ground upon which the challenge is made by the petitioners can only be examined by the trial court and therefore no ground is made out to entertain the petition to quash the criminal proceeding. However at this Juncture, learned counsel for the petitioners submits that only single head injury was received by the informant and therefore the petitioners should be directed to surrender and release on bail and surrender on such terms and conditions as would be just and proper.

Having regard to the facts and submissions and keeping in view the limited prayer involved herein, the CRLMC stands disposed of directing the petitioners to surrender before the learned J.M.F.C., Jajpur Road on or before 30th September, 2022 in connection with C.T. Case No.755 of 2019 arising out of Jakhapura P.S. Case No.41 of 2019 and in the event of their surrender, the court below shall release them on bail subject to conditions. 5.
