It is submitted by the learned counsel for the petitioner that the trial is underway and at that stage, the learned court below issued NBWA against the petitioner, who has all long been attending the court ever since granted bail. It is further submitted that the petitioner was released on bail pursuant to the order in BLAPL No.5306 of 2012 of this Court.

Considering the above submission, the CRLMC stands disposed of with a direction to the petitioner to surrender before the learned Additional Sessions Judge, Athagarh in connection with S.T. No.176 of 2012 on or before 20th October, 2022 and in the event of his surrender, the court shall release him on bail subject to conditions as deemed just and proper.

An urgent certified copy of this order be granted as per rules.
