The Petitioner in this CMP seeks to assail the order dated 17th August, 2022 (Annexure-5) passed by learned Senior Civil Judge, 1st Court, Cuttack in C.S. No.789 of 2016. 3.

Mr. Mishra, learned counsel for the Petitioner submits that since the Plaintiff-Opposite Party has already withdrawn the suit in the meantime, the CMP has become infructuous. 4.

In view of such submission, the CMP stands disposed of as infructuous.

Interim order dated 15th September, 2022 passed in I.A. No.942 of 2022 stands vacated.
