I.A. No.1746 of 2022 1.

This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

This I.A. has been filed seeking modification of the order dated 05.09.2022 passed in ABLAPL No.10353 of 2022. 3.

Heard learned counsels for the parties.

Learned counsel for the Petitioner submits that the Petitioner is having one more criminal antecedents of similar nature in his name.

Considering such submission of learned counsel for the Petitioner, the condition of verification of criminal antecedent of similar nature of the Petitioner, as has been directed vide para-4 of the aforesaid order dated 19.09.2022, is hereby waived. But in its place the further condition is imposed that the release of the Petitioner shall be subject to furnishing cash security of Rs.5,000/-

// 2 // (Rupees Five Thousand) by the Petitioner to the satisfaction of learned court in seisin over the matter.

Four weeks' further time from today is extended for the Petitioner to surrender before the learned court below, vide order dated 19.09.2022 passed in ABLAPL No.11492 of 2022, but subject to depositing cost of Rs.500/- (rupees five hundred) by the Petitioner in the Advocates' Welfare Fund of Orissa High Court Bar Association within 15 days from today and furnishing money receipt thereof in proof of the deposit.

It is made clear that, if the cost is not deposited within the time stipulated, the time extended for the petitioner to surrender shall stand revoked automatically.

The I.A. is accordingly allowed and disposed of. 9.
